Rental Registration Number STR22-00320 The space Please note: This property is in a quiet residential community and Folly Beach has a strict noise ordinance violation rule of 1 strike. Respect your neighbors, keep the noise down, and NO parties or events. Spacious four bedroom, four full bathroom home. Featuring three full bedrooms and three full bathrooms upstairs with a living area and full kitchen upstairs. The fourth bedroom is in the "mother in law suite" attached to the house with a private entrance that can be rented for extra guests, on the ground level with a separate entrance located at the rear of the main house. The apartment has a full kitchen, living area, full bathroom, and bonus room. Two full kitchens and separate spaces make this home ideal for families. The downstairs living room has a queen size pull out sleeper sofa, and there is a small bonus room with a futon downstairs that could be used as an additional sleeping area for small children and/or office space. The upstairs living room has a full size sleeper sofa. There is a washing machine and a dryer on both floors. Upstairs, two of the bedrooms have a King bed, and the third upstairs bedroom has a custom bunk bed with a with a single and queen size bed. The apartment suite downstairs has a King bed in the bedroom. Each bedroom has high end mattresses, upgraded linens, and flat screen TVs. The outdoor area is completely fenced and private with lush landscaping, a concrete patio sitting area and shower to rinse off after a day at the beach. When you’re ready to head to the beach, just grab the beach cart and two beach chairs and take the quick 3 minute walk to the beach using the beach access near the home. We are dog friendly! We have a one-time pet fee of $110 per dog for reservations up to three nights, and $150 per dog for reservations for four or more nights. The pet fee is added once your reservation is confirmed. The apartment is just a quick 3 minute walk to the ocean, 6 blocks from the Folly Beach fishing pier, restaurants, bars and shopping on Center Street, and only a 15 minute drive from beautiful historic downtown Charleston. Other things to note GUESTS ARE REQUIRED TO ELECTRONICALLY SIGN A RENTAL AGREEMENT WHICH IS SENT VIA EMAIL. CHECK-IN INSTRUCTIONS ARE NOT SENT UNTIL THE RENTAL AGREEMENT IS SIGNED. TERMS AND CONDITIONS A completed “Vacation Rental Agreement” is required to hold your reservation. Review and acceptance of the Terms & Conditions which is made part of this rental agreement must be signed and returned to us, per our requirement of confirmation. RESERVATIONS AND PAYMENTS: Airbnb reservations are paid to the host directly from airbnb; guests do not pay the host directly. Hosts do not receive the full amount that guests pay to Airbnb for reservations. Airbnb also charges guests for state taxes and an Airbnb Service Fee for using the Airbnb website. The Rental Agreement that guests sign will only reflect the amounts hosts will receive from Airbnb, it does not show fees that airbnb does not release to hosts, such as the airbnb fee. For the total amount that guests have paid, guests may refer to their airbnb account. Airbnb is a third-party website that takes guest payments and releases them to the host at a later time. Hosts cannot show payments on the Rental Agreement if they have not been received yet, guest payments are guaranteed by airbnb. OCCUPANCY: The property can accommodate no more than maximum occupancy of {reservations.unit_max_occupants} guests, this includes both adults and children. No more than the number of guests stated on the reservation shall occupy the premises. Dogs are allowed upon approval. The rental is not intended for parties or gatherings at any time. Absolutely NO Parties are to be held on the property. The property is intended for quiet gatherings only, we cannot host parties or events. If there is excessive noise or music, any illegal activity, or evidence of violation of any policies, you may be asked to vacate the premise without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival. IF IT IS DISCOVERED THAT MORE THAN THE ALLOWED NUMBER OF GUESTS HAVE OCCUPIED THE PROPERTY, ADDITIONAL CHARGES FOR BREAKING THE HOUSE RULES MAY BE ADDED. SECURITY DEPOSIT: Airbnb guests do not pay a deposit. Airbnb may charge additional fees to the guest unless (1) no damage was done to the property other than reasonable wear and tear, (2) all keys are accounted for, (3) no items were missing, (4) all doors and windows were closed and secured upon departure, (5) all check out procedures were followed, (6) all Rental Agreement policies were followed, (7) no miscellaneous charges were incurred, e.g., unpaid rental fees, guests or pets, additional cleaning fees, or other charges. Any damages, outside of what is deemed as normal wear and tear, are the responsibility of the guest. Charges for repairs are non-negotiable. CLEANING CHARGES: A non-refundable cleaning fee is required with all reservations. This fee is for our housekeepers who dust, vacuum, sanitize, clean linens and towels, and get the home ready for your arrival. Guest(s) are asked to follow all check out procedures detailed in the rental agreement and leave the property in the same general and good comfortable condition it was in upon arrival. CONDITION OF RENTAL: NO Smoking: Smoking is NOT permitted in any property. If there is tobacco or smoke smell in the home after your departure, you may be required to pay an additional $250 charge for deep cleaning; violation of the no smoking policy will result in additional fees. Pets: We are dog friendly; dogs are allowed upon approval. A non-refundable pet fee will be charged based upon the length of stay; reservations 3 nights or less will pay a $110 per pet fee, or reservations 4 or more nights will pay $150 per pet. You are responsible for walking and cleaning up after your pet. All waste must be picked up and placed in the garbage cans tied securely in trash bags. Pets may not be left unattended in the home unless kenneled. We ask that you do not allow your pets on the furniture or bedding, and that you clean up any pet messes before you depart. Any signs of pet damage inside or outside of the property will result in additional fees and is non-negotiable. Home Equipment: All of our properties have a TV in the living space and in each bedroom with subscription packages for cable and internet services. We inspect equipment prior to arrival and immediately after departure. Some properties are equipped with sophisticated electronic equipment so we ask that you do not under any circumstances disconnect and/or tamper with wiring or modify configurations to add other devices or services. You will be responsible for the total cost of service call if a repair technician is needed to reconfigure wiring or reset functionality of the system. Furnishings: The apartment is privately owned and reflects the owner’s personal taste. It is equipped with basic items such as TV, bed spreads, pillows, mattress pads, cookware, flatware, microwave, toaster, blender and coffee maker. Prior to departure please return all furniture to its original position. Linens & Towels: Linen service is included in your rental rate. All beds will be made with fresh sheets. Each guest will be provided with 2 bath towels, 1 hand towel, and 1 wash cloth per person, in addition to 2 kitchen towels. Beach towels are not provided; we do not provide any linens or towels for outdoor use. DO NOT take the home's linens or towels outside. Bring items with you that you may need for outside activities. Utility Services: Such as, but not limited to Power, Water, Sewer, WiFi may be out of service from time to time. Please know that this is beyond our control. All we can do is contact the company responsible and put in a service call, but we are not responsible for the length of time it may take them to fix the problem. The property is located on a barrier island. Phones: There is no land line available. It is up to the tenant to have a cell phone for emergencies. Items in the Home: All items and equipment should be in working order. Please notify us promptly should you encounter any problems. We will make every effort to have repairs made as soon as possible. Please do not adjust the settings on the refrigerator. Please do not run the HVAC system with the windows or doors open. A refund will not be issued for any mechanical failures of appliances or HVAC systems. HEAT AND AIR: PLEASE KEEP THE A/C ON 72 DEGREES AND LEAVE THE DOORS TO THE BEDROOMS OPEN AS MUCH AS POSSIBLE TO ENSURE AIR FLOW AND A COMFORTABLE CLIMATE IN THE HOME. Hot Water Heater Maintenance. We are not responsible for the mechanical failure to the hot water heating elements due to them freezing or failing. In the case of freezing, the guest will need to wait for the pipes to thaw. We will replace or repair if needed as soon as possible. Exterior of Home: No lawn art of any kind will be allowed on exterior property, including no boats, trailers, storage building, activity equipment including trampolines, pools of any kind shape or size, spas, fire pits, etc. Landscaping/mosquito control: Please understand that the landscaping will be kept up once a week. Also, as a courtesy to our renters we have the property organically sprayed once a week to help control the mosquitoes. There will be no notification on such routine maintenance. CHECK-IN PROCEDURE: Check-in is at 4 PM. You will receive an email one week before your arrival with all check-in property information. The property is self check-in. Please call us if you need assistance with checking in, we can be reached anytime by phone. CHECK-OUT PROCEDURE: Check-out is 11:00 AM. Your prompt departure is appreciated so we can prepare the home for any incoming guests. Guests are asked to remove all food products from the pantry, fridge and freezer. We ask that you please start a load of towels in the washing machine if applicable, start a load of dishes in the dishwasher, and place your trash in the bins outside. RETURN any physical keys back to the lock box where you found them. LATE CHECK OUT: You agree to leave the property no later than the check out time specified. Check out is 11:00 AM. If you stay past the check out time without the Host's consent ("Overstay"), you no longer have a license to stay in the property and the Host is entitled to make you leave in a manner consistent with applicable law. In addition, you agree to pay, if requested by the Host, for each twenty-four (24) hour period (or any portion thereof) that you Overstay, an additional nightly fee of up to four (4) times the average nightly rate originally paid by you to cover the inconvenience suffered by the Host, plus all applicable Guest Fees, Taxes, and any legal expenses incurred by the Host to make you leave (collectively, “Overstay Fees“). PERSONAL ITEMS LEFT BEHIND: We are not responsible for lost or misplaced items. However, if notified, we will exhaust all avenues to search for the missing items and return them at the guest’s expense. WAIVER OF CLAIMS AND INDEMNIFICATION: To the fullest extent permitted by the law, Tenant, on behalf of the Tenant and the Tenant’s guests, licensees, invitees, agents, representatives, successors and assigns, as a part of the consideration for the Owner agreeing to lease the premises to Tenant, hereby specifically releases, waives and agrees that neither Tenant nor Tenant’s guests, licensees, invitees, agents, representatives, successors and assigns shall make any claim against Owner or its agents, representatives, successors and assigns for damage, injury to person or property, loss, or any liability whatsoever which in any way relates to or arises out of the subject matter of this lease or the use or occupancy of the premises, including, without limitation, theft, damage or destruction of any item owned or brought to the premises by the Tenant or Tenant’s guests. Licensees, invitees, agents, representative, successors or assigns, which such injury, damage, loss or liability results from any act, neglect, occurrence, or condition in or about the property, whether same is caused by the actions of Owner or any other person or the condition of the premises or any part thereof. Tenant, on behalf of himself/herself and /or their guests, licensees, invitees, agents, representatives, successors and assigns, harmless from and against any and all liabilities, actions, claims, demands, costs, losses and damages, including, without limitation any damage to the property at the premises, including all attorney’s fees and court costs incurred, relating to or arising out of this lease or which in any way arise out of or result from the use of the premises or any act, negligence, fault or omission of the Tenant or Tenants guests, licensees, invitees, agents, representatives, successors and assigns. The language of this section shall survive the expiration or earlier termination of this agreement. Due to a high volume of inquiries, our properties are booked in the order in which the signed rental agreements are received. CANCELLATION AND REFUNDS: Notice of cancellation must be in writing and can be done via email. Your advance payment is refundable in full provided that the cancellation is received 60 days or more prior to your arrival date. However, there is a non refundable $100.00 cancellation fee that will be applied to your refund. Cancellations made less than 60 days but more than 30 days prior to arrival, will forfeit 50% of the full amount for the entire reservation. Cancellations made less than 30 days prior to the arrival will not receive a refund. Refunds are not given for inclement weather, road or airport closings, late arrivals, or early departures. CATASTROPHIC EVENTS & EMERGENCY EVACUATIONS: If a mandatory evacuation of the island is ordered by our Government Agency in the event of a catastrophe such as a hurricane, tornado, earthquake, flood, etc. or any situation simply beyond our control a refund will be prorated based on the nights left in your stay; only the nights affected by the mandatory evacuation are eligible for refund. If a hurricane occurs prior to your arrival and we are unable to provide you with accommodations, a refund will be issued to the reservation holder. ACKNOWLEDGEMENT: I, the undersigned, hereby apply for the above listed accommodation and warrant that I have read, understand and agree to the terms and conditions of this application, and I agree to abide by homeowners restrictions on use of said property. I further attest that I am over 21 years of age. ADDITIONAL CHARGES WILL BE HANDLED THROUGH THE AIRBNB RESOLUTION CENTER. Per Page 1 of this Agreement, it is hereby agreed that unpaid rent, excessive cleaning, damage, lost keys or lock-outs may be charged through the Airbnb Resolution Center if necessary. Guests are also required to review the attached City of Folly Beach Rules and the attached Parking Diagram with the Rental Agreement.
