This comfortable, spacious, custom teak home has the feel of a luxurious hotel or tropical getaway. You will notice the woven lauhala ceiling, wooden hand carved trim, island landscaping and fountains around the property. The house includes 3 full size bedrooms plus a bonus room with 2 twin beds. and 2 full baths plus half bath. KITCHEN (upstairs): Large open concept kitchen. 6 burner gas stove with flat top grill, french door fridge, dishwasher and disposal. The kitchen is fully stocked with everything you will need for your stay, including complete sets of stainless and non stick executive cookware, Keurig stainless coffee and espresso with water tank, Tiger rice cooker, Cuisinart blender, toaster and food processor, and every kitchen tool you would need including spice rack for all of your cooking needs. LIVING/DINING ROOM (upstairs): Tastefully decorated open concept living and dining area features a mango wood and stone dining table which comfortably fits 8 adults. Island includes 3 additional stools. AC: The house has brand new AC units installed for the upstairs living, dining, kitchen and main bedroom. If on, it will also keep the downstairs generally cool. Ceiling fans are included in downstairs bedrooms. Typically AC is not necessary with the trade winds however it is nice on those muggy days/nights. MAIN BEDROOM (upstairs). Huge main suite with California king bed and walk in closet. MAIN BATH En-suite bath with double sinks, copper tub, separate shower, and private lavatory. French doors lead to deck with sitting area and view of the ocean including one surf spot. 50" smart TV, for streaming, HD cable channels. BEDROOM 2 (downstairs): 2 twin xl beds, or king, you decide!! We can put the 2 beds together insert a memory foam bridge and make the bed as a king instead. Brand new ceiling fans installed. LOCATION The house is located across the street from a white sand beach and 3 famous surf spots, Alligator Rock, Leftovers/Rightovers and Hawaii 50's. It is between Lanis (turtle Beach)/Chuns and Waimea. We are a 5 min drive to Haleiwa and Sharks Cove. SUMMER. May to August There is great snorkeling, stand up paddle boarding, fishing, and the occasional small fun swells. Go jump off the rock at Waimea, check out turtle beach and great food in Haleiwa or Sharks Cove. WINTER: September to April there are often North swells creating waves as large as 30 to 50'. The beach in front of the house is generally protected and can be fun for kids and families during this time. However, please be very careful. We recommend you know before you go by researching wave heights and swell trends at surfline before going to any beach on the North Shore during winter. This beach is not patrolled by life guards however at beaches where they are present talk to life guards about conditions and safety. Know before you go to the ocean during this time. If in doubt don't go out. NORTH SHORE: The north shore is what we in Hawaii call "The Country". People live here for a sense of calm and laid back atmosphere, beaches, surf and to get away from commercialism. Please always be respectful of locals and neighbors, at the home as well as anywhere in Hawaii. Also remember in the country you will have geckos (they are our friends because they eat the bugs), dogs, cats, chickens, cows, horses, cockroaches, ants and the occasionally mongoose... fortunately no snakes!!! Also know there is only one highway through the north shore so there is some highway noise in most homes around the north shore. CHILD SAFETY: The home is not set up with child safety measures or child proofing. It includes decks, stairs, uncovered outlets and cabinets that open to cleaning supplies. It is the sole responsibility of the renter with children to provide age appropriate safety measures for their children. Other things to note OCCUPANCY & PRICING (30 day block): Please request booking or quote through AirBnB. We can negotiate the rate based on number of tenants, utility use (such as water, AC and Hot tub) and other factors. We follow Hawaii State/.City/County rules only allowing one booking per 30 day consecutive date block. Total pricing for the listing for 30 day booking, not a daily rate, and you can use or occupy property anytime during that 30 days. CONTRACT: Upon booking, we will provide a formal rental agreement to sign. The details of this contract are below and enforceable from the time booking is made through AirBnB. However signed formal agreement is also required listing names and ages of tenants. PROPERTY ADDRESS, RENTAL DATES, 30 DAY TERM AND OCCUPANCY DATES, AND PAYMENTS will all be specified based on booking. PRICING (specified on booking through AirBnB. PROPERTY SHARED ELEMENTS: There are 2 houses on this large property. The fencing defines which areas belong to each property. Anything outside the bamboo fencing and right-side entrance gate is shared. Please do not enter the other property fencing, boundary, or house without authorization from both landlord AND other property owner. The driveway area is a shared area. GATES AND YARD: The front yard is secured by 2 gates and a removable barricade on the west side of the house. The back yard secured by a back gate. Please keep gates always closed. DRIVEWAY: The driveway area is shared and do not block access to the back house at any time, even for a very short time as it can block access to their property. See house rules and below contract agreement for detailed instructions and penalties in event of inconveniences to other owners. PARKING – Parking is limited to two (2) vehicles inside the gate. DO NOT UNDER ANY CIRCUMSTANCES BLOCK THE GATE OR DRIVEWAY. Vehicles are to be parked inside the 2-car garage. The house and garage are the house on the RIGHT side when you enter You are allowed to enter the gate and pull to the right in front of the garage while you unpack. Note the height on the garage and do not enter the garage with surfboards or other large items on top of the car. This is a shared driveway, and we cannot block access to the back house. In the event you block the driveway or back house is unable to access their property for a minute or two, you will be sent a friendly reminder. In the event there is a second time where the driveway is blocked, or an obstruction that is not resolved in a few minutes, there will be $200 fee. In the event there is a second offense, you will be considered in violation of this contract, and you will be evicted from the property. Any or all additional vehicles must park outside. There is legal parking across the street and in neighborhood streets to the left and right of the house. Please Park in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. SEPTIC – The Property is on a septic system. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper and natural waste. No feminine products, wipes, flushable wipes, paper towels, food, hair, coffee grounds, or greese or oils should be flushed or put in the sink at any time. If it is found that feminine products have been flushed and clog the septic system, you could be charged damages more than the $1000 damage waiver deposit paid. HOT TUB: The hot tub MUST REMAIN COVERED AND 4 LID LATCHES CLICKED AND CLOSED WHENEVER IT IS NOT IN USE. Injury to anyone as a result of not following this rule will be the sole responsibility of the tenant. The hot tub includes a sign on it covering rules of hot tub use. By signing this agreement, you agree that any and all individuals will read and abide by the rules of the hot tub. A few of the more important highlights in summary include no glass in or around the hot tub, children must be monitored while in the hot tub, small children/infants, elderly and pregnant should not enter the hot tub. If there are any issues or problems with the hot tub please let us know immediately. There is a bin provided next to the hot tub that can be filled with water to dip feet in prior to entering the hot tub, however anyone entering the hot tub should shower prior to entering in the front shower or hose. There is a small net on the side of the hot tub to collect debris. If the water becomes cloudy or excessively dirty please let us know to provide maintenance, particularly for longer stays. In the event there is excessive sand, oils or debris in the hot tub and it needs to be drained and refilled, a $200 charge will apply. Please be considerate of the neighbors and do not use the hot tub after 10pm unless extremely quiet. HOT TUB OPERATION: Operation is fairly simple. Feel free to call if you have any questions. 1) Press the red temperature button to increase heat 2) Press the blue temperature button to reduce the heat. 3) Press the Jets button once to turn on light jets/ 4) Press the jets button again to run full jets. 5) You can turn the dials at each seat (outer rim of tub) to change the intensity of the jets and turn on or off. 6) Turn the light button or off. 7) The jets will turn off automatically when not in use. 8) When you leave the hot tub turn temperature down to 100 and back up to higher temperature when you return to avoid overheating if left at 104 for long periods. ALL TENANTS RESPONSIBLE – By signing this Rental Agreement, you agree to pay the rent in full and comply with its terms. Each tenant is also responsible for other tenants and make sure they comply with the terms of this Agreement. The responsible Tenant signing this Rental Agreement must be at least 25 years of age. DAMAGE – In the event of damage to property or contents, let us know at time of incident or latest at time of departure. Any damage will be photographed and reported back to you in writing with assessment of damage amount. Any damages will be the sole responsibility of the primary tenant of the property (who signs agreement). Payments for the property will not be applied toward damage ADDITIONAL FEES: Please notify the owner of any damages or additional fees in writing (text, email) at time of occurrence so we can resolve prior to departure. The following is a list potential list of examples (potential not limited to) what will require additional cost from the primary tenant of the property (who signs agreement). • Damage is done to unit or its contents, beyond normal wear and tear. • Charges that are incurred due to contraband, pets or collection of rents or services rendered during the stay. • Debris, rubbish, and discards are placed in appropriate trash bins, and soiled dishes are placed in the dishwasher and cleaned. • All keys and garage openers are left on the table at the front entrance, and unit is left locked. Please use the key from the lock box to lock the unit. Please always leave key in lock box during your stay and return it to the lock box before departure. Each lost gate or garage opener will be charged $150 for replacement. • No linens are lost or damaged. • No early check-in or late checkout unless otherwise agreed to in advance. • No Smoking anywhere on the Property. Smoking violations will require added cleaning fees which could exceed $5000 to sanitize all furnishings, carpet and bedding. • The renter is evicted by the owner (or representative of the owner) or local law enforcement and associated costs. • Excess phone or cable charges • Excessive cleaning charges • Excess services required • Theft of any item (property of the owner or guest) will be the sole responsibility of the primary tenant of the property (who signs agreement). Please keep the house locked and contents inside the house. • Any other fines imposed and/or costs of enforcing this lease. We will provide a complete list of damages and additional charges within 14 days following the end of the tenancy and require payment of any additional fees within 14 days of receipt of damage and additional charges report. If the TENANT has provided a credit card, the TENANT hereby authorizes the LANDLORD to charge these charges to his/her account. TENANT shall report any damage noted upon arrival to avoid any Damage Deposit losses. MAXIMUM OCCUPANCY – The maximum number of guests is limited to eight (8) persons. No one other than those identified as Tenants on the last page of this agreement is permitted to reside on the Premises. Tenant certifies that only the individuals listed on the Registration will occupy the house. Any unregistered individuals will be considered unauthorized and additional fees of $100 per person per day may be charged. If it is brought to our attention that there are unregistered guests and/or an event on the premises and/or any violation of other terms and conditions, owner/agent reserves the right to enter the property to review the situation and impose fines and fees, if necessary. This home has a caretaker 20 feet from the premises-Guests acknowledge and accept this. COMMERICIAL ACTIVITIES: 1. Commercial Activities Prohibited: Tenant agrees not to conduct any commercial business or activities on the rented premises. This prohibition includes, but is not limited to, the following: a. Videography or Photography for Social Media: Tenant shall not engage in videography or photography on the property for the purpose of use in social media or any commercial endeavor. b. Commercial Transactions: Tenant shall not engage in any business transactions, sales, or exchanges of goods or services on the premises. 2. Exclusion of Commercial Use: The rental property is intended solely for residential purposes. Tenant agrees not to use the property for any commercial purposes whatsoever, including but not limited to operating a home-based business, hosting events for profit, or offering services to clients on the premises. 3. Enforcement: Landlord reserves the right to enforce this prohibition against commercial activities. In the event of a breach of this provision, Landlord may take appropriate legal action, including termination of the tenancy and seeking damages for any losses incurred as a result of Tenant's breach. NO DAILY HOUSEKEEPING SERVICE – While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit bath towels or linens to be taken from the unit, but we provide extra beach towels for your use. FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of all Payment, and the party will not be permitted to check in. Any misrepresentation about the nature or size of the group, use of the property or any other misrepresentation, or any breach of any part of the rental agreement will result in fines or removal from property. WRITTEN EXCEPTIONS – Any exceptions to the above-mentioned policies must be approved in writing in advance by the owner. HURRICANE OR STORM POLICY – No refunds will be given unless: • The state or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or • A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest. • The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund: o Any unused portion of rent from a guest currently registered. o Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted; and o Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period. PETS, PARTIES, NOISE, ETC. - There are to be absolutely no pets, parties, receptions, functions, gatherings, or other events without the written consent of the Landlord. Tenant acknowledges that UNAUTHORIZED EVENTS WILL RESULT IN AN ADDITIONAL CHARGE OF A MINIMUM OF $1,500.00 PER OCCURANCE. The Property cannot be sublet or assigned to others. There will be NO FIRES on the property at any time. THE ENTIRE DEPOSIT SHALL BE FORFEITED IF TENANT VIOLATES ANY OF THESE TERMS AND WILL BE LIABLE FOR ADDITIONAL DAMAGES IF THE AMOUNT EXCEEDS THE SECURITY DEPOSIT. WATER FEATURE: To turn on, see plug to the right of the front door when facing the door. Turn dial to on position and it will run, If water gets low, you can refill using the hose in the front yard. BIKES: 3 Bikes and a Bike pump are provided. If you want to rent additional bikes you can do so at Shark’s Cove or in Haleiwa. Helmets are not provided due to different sizes and users. However, helmets are strongly recommended. Please ride in bike paths. The owners are not responsible for any bike related injury. Ride at your own risk. Please lock the bikes with the locks provided on 2 of the bikes. Code for both is 2554. A stolen bike will need to be replaced at cost of a new bike of similar quality and is the responsibility of the guest. DISTURBANCES – Tenant will be highly considerate of the neighbors. The Property shall not be used in such a manner as to generate noise (including loud music) which will disturb the neighbors, nor will the neighbors be harassed or bothered in any manner. Absolute quiet time begins at 10:00 pm until 8:00 am daily. SMOKING – There is absolutely NO SMOKING permitted in the house or on the Property. Any sign of smoking is grounds for immediate eviction and will result in loss of the entire Damage Deposit by Tenant. CHILDREN – All children shall be always supervised. This home is NOT CHILD PROOF and requires children to be constantly supervised. The gate at the top of the exterior staircase is NOT FOR CHILDREN and not child safe. It is to keep animals in or out. Tenant alone is responsible for child safety. Extra attention should be directed towards, but not limited to, steps, decks, slippery surfaces, edges and street and beach access. Children should also be monitored about care of the home (i.e., avoid touching glass on doors, blinds must only be controlled by adults, spills, stains, and wooden floors and carpeting, etc.). DECK and LEDGES – Absolutely NO STEPPING OR CLIMBING on second floor ledges or deck railings, as a fall from such can result in severe injury or, even death. Further there is a large gap at the bottom of the deck that a person can slip into or through with the same potential result. All guests must be careful, and the signing guest is responsible for communicating risks to other guests. When Children are in the house, please keep windows upstairs closed and locked as they face outward and can cause injury or be broken if a child or person puts weight on the exterior open windows BEACH ACCESS: Proceed across the street using the crosswalk right in front of the house. ALIGATOR ROCK (to the right when facing the ocean): Walk to the right about 50 yards there is a public access to a white sand beach right in front of alligator rock. This is a private nice beach that does change depending on the season. Great for snorkeling in summer, and inside boogie boarding, and large waves during the winter. There are no lifeguards at this beach. LEFTOVERS (to the left when facing the ocean): Walk about 150 yards on the road then through a path to the ocean. Continue walking along the water on the rocks to a beautiful white sand beach and small swimming cove. Again, very secluded, and private, great for a long walk down a sandy beach toward Chun’s. The cove is great for small kids swimming even during the winter (careful of large swells however). This is a great longboard and stand-up wave, nice local older crowd. Please respect the locals in the water and check surf reports before you go in the water. There are no lifeguards at this beach. OCEAN DISCLOSURE - Landlord hereby discloses that the ocean near the Island of O'ahu constantly changes with the tide, moon phase, time of year, weather conditions and other factors that are beyond any person’s control. Landlord cannot guarantee that there will be a certain amount of sandy area, nor can landlord guarantee the beach and water conditions during Tenant’s stay. Tenant is hereby advised that the ocean and reefs are inherently dangerous, that Hawaiian waves and currents are much stronger than those existing in other areas and that extreme caution must be exercised by anyone who chooses to participate in any ocean activities. HOUSEHOLD SUPPLIES – Landlord will provide a reasonable amount of hand soap, dishwashing detergent, laundry detergent, paper towels, toilet paper and garbage bags to start your stay. Additionally, a variety of spices and cooking ingredients may be available for Tenant’s use. All other household and cooking supplies needed shall be the responsibility of the Tenant. Clean linens, bath towels and beach towels will be provided upon your arrival. ALTERATIONS – Tenant agrees no alterations shall be made to the premises, nor locks installed anywhere. WEAR & TEAR: TENANT agrees to maintain the premises in the same condition as when received and will not allow any waste, misuse or neglect. Should any waste, misuse or neglect occur on the leased premises, it will be the sole responsibility of the TENANT and TENANT agrees to promptly pay the reasonable costs thereof. CLEANLINESS: TENANT agrees that the premises shall be kept in as clean, healthy and safe as conditions of the Premises permit and shall cause no unsafe or unsanitary conditions. Please make sure all guests wash or wipe the sand & dirt off their feet every time before entering the house. When going to the beach, please use the beach towels provided. Do not use bath towels for the beach. When returning from the beach, please rinse bodies and feet using the outdoor shower and hose. Please make sure to shake the sand out of the beach towels and beach mats before coming inside. NOT INCLUDED – Not included in this agreement is daily maid service, baggage handling, long distance charges, pay per view charges, auto rental, food, liquor, laundry, personal items, excessive wear and tear, or excessive cleaning upon departure (i.e., stained or soiled cushions, upholstery, carpet shampooing, etc.) MOVE-IN/MOVE-OUT – Before you move in: Please inspect the condition of the Property carefully. If you notice that anything is broken, please notify us in writing via text or email (but feel free to call as well). When you move out: you must take all personal items with you. You must leave the Property in the same condition as when you arrived. If anything was damaged while you were there, you are responsible for notifying us so we may repair it. You will not be held responsible for normal wear. FURNISHINGS: TENANT agrees not to move or alter any of the furnishings and shall use them only for the purposes intended. TENANT shall respect and protect all furnishings and decor and understands that many of the furnishings are unique and valuable. TENANT shall be solely responsible for the replacement value of any damaged or destroyed furnishings on the leased Premises. Care share be taken not to damage furniture with wet or soiled clothing or swimsuits. Beach towels provided shall be placed on outdoor furniture to prevent soiling from sunscreen and suntan oils. NEEDED REPAIRS: Tenant agrees that should any repairs be necessary, the Landlord or the designated property manager will be notified as soon as possible. Please make sure all hoses are turned off completely when you are finished using them and report any leaks. FAILURE OF A SYSTEM, APPLIANCES OR AMENITY: In the event the Premises sustains a failure of a utility, system, amenity, or appliance - including but not limited to water, sewer, electrical, mechanical, or structure systems: electronic or entertainment equipment or service, or any appliance- neither the Landlord, Owner, their employees, agents, or contractors, or property manager shall be liable to TENANT in damages and no refunds will be given for such failures. However, the Landlord, upon being notified of any malfunction will make a reasonable effort to promptly repair or replace the failed system or advertised equipment. The salt air from the ocean inflicts tremendous strain on systems, equipment, and appliances. This coupled with the difficulty of getting parts to this remote island can be challenging. TENANT understands and accepts the fact that this Property is leased for its tropical appeal, and some cases, it may be unreasonably difficult or impossible to get a malfunctioning system, amenity or appliance operating within the lease period. KEYS/GARAGE OPENERS: Entry instructions will be provided upon receipt of final payment. Loss of the garage door opener or gate opener each shall result in a fee of $150.00 plus replacement costs. Lost key charge is $75.00. TENANT'S PERSONAL PROPERTY: TENANT'S personal property and effects are the TENANT'S sole responsibility throughout the tenancy. LANDLORD'S insurance will not cover TENANT'S personal property and TENANT agrees to carry his/her own insurance on such property and personal effects. All personal property of the TENANT on said premises shall remain his/her sole responsibility and risk, and the Landlord shall not be liable for any loss or damage due to theft, or loss of such personal property arising from any acts or negligence of any other person, nor from the leaking of the roof, or from bursting, leaking, or overflowing of water, sewer, or from plumbing fixtures, or from the handling of electrical wires or fixtures, or from any cause whatsoever, nor shall the Landlord be liable for any injury to the TENANT or other person in or about the premises, the TENANT expressly agreeing to save the Landlord harmless in all such causes and events. ACTS OF GOD/CONSTRUCTION NOISE: Landlord shall not be liable for events beyond its control which may interfere with TENANT's occupancy, such as Acts of God, acts of governmental agencies, fire, strikes, war, inclement weather and construction noise from nearby sites. NO REBATE OR REFUND will be offered in these circumstances. INSURANCE: TENANT agrees that Landlord shall not be liable for travel disruptions, TENANT's personal property or illness or injury. TENANT is strongly encouraged to purchase a Vacation Insurance Policy. RIGHT OF ENTRY: The Landlord, his agents or representatives shall have the right to enter the Premises during reasonable hours to inspect, make alterations and/or repairs, and to provide maintenance as Landlord may deem appropriate. TENANT acknowledges that routine caretaking and grounds maintenance will occur periodically during the lease period. ABANDONED PERSONAL PROPERTY: When the TENANT vacates or abandons the property any personal property left behind on the premises shall be deemed abandoned by the TENANT and LANDLORD shall not be held responsible. During TENANT's occupancy TENANT is solely responsible for the security of all of TENANT's personal property and the LANDLORD shall not in any way be liable for loss, theft, or damage of the same. Additionally, TENANT shall however, be responsible for LANDLORD's personal property under the TENANT's control by virtue of this lease. If you leave something behind, we will make every effort to locate it and return it to you C.O.D. Items unclaimed after thirty days will be donated to charity. ASSIGNMENT: This lease may not be assigned, or any portion of the Premises sublet. Any attempt to do so shall be considered a material breach. SURRENDER OF PREMISES: TENANT covenants and promises to surrender the premises in as good and the same condition as the commencement of the rental period, reasonable wear and tear excepted; and to reimburse Landlord the amount, including reasonable attorney's fees, for all other damages. Soiling and/or discoloration of furniture is NOT considered reasonable wear and tear and will be billed as additional cleaning or damage. EXPEDITED EVICTION: If TENANT (i) holds over in possession after the TENANT's tenancy has expired; (ii) commits a material breach of any provision of this agreement (including any addendum hereto) that according to its terms would result in the termination of TENANT's tenancy; (iii) fails to pay rents as required by this agreement; or (iv) has obtained possession of the Premises by fraud or misrepresentation, the TENANT agrees to an expedited eviction as the law allows. LAWS: Tenant agrees that no laws, statutes or ordinances of a jurisdictional government agency will be violated on the premises nor the Premises used for any such purpose. ENFORCEMENT OF LEASE: Tenant agrees that should LANDLORD incur any expenses in enforcing the terms of this Lease, TENANT shall promptly reimburse LANDLORD 100% for such expenses as LANDLORD shall deem reasonable. DEFAULT BY TENANT: TENANT agrees that every condition, covenant and provision of this lease is material. A breach of any of these will constitute a material breach giving the Landlord the right to terminate this lease, the right to immediate possession of the premises, the forfeiture of all deposits and the right to all damages including but not limited to costs of enforcement and reasonable attorney's fees. SOLE AGREEMENT: This document including any attachments incorporated by reference herein constitute the entire and sole agreement between the Landlord and TENANT respecting the leased Premises, the leasing of the Premises to TENANT, and the lease term created under this Lease, and correctly sets forth the obligations of Landlord and TENANT to each other as of its date. Any oral or verbal agreements or representations respecting the leased premises or their leasing by the Landlord to TENANT not expressly set forth in writing in this agreement are null and void. Only written agreements shall constitute this lease. CHANGES: To be enforceable, the parties hereto further agree that any changes to this agreement are to be in writing and approved by both parties or they will be deemed null and void. The use of the word TENANT (aka Guest) shall include both singular and plural. LIABILITY – The owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. Tenant shall be liable for all acts of the family, invitees, guests present on the property. Should there be any illegal action arising from/relating to occupant(s) use of residence, Owner shall be entitled to recovery of all legal fees and costs. RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT: In consideration for the right to occupy the vacation rental, the Tenant acknowledges and agrees as follows: 1. Tenant(s) agree to inform all people who will be on the property at the request of Tenant(s) or by invitation of the Tenant (s), of the terms and conditions of this agreement and to monitor compliance with terms and conditions. 2. TENANT agrees to indemnify and hold harmless Owner and Landlord and their representatives from and against any liability for personal injury or property damage or loss of enjoyment resulting from events beyond the owner and agents’ control (e.g., The weather) sustained by any person (including TENANT's guests) because of any cause. 3. Tenant(s) acknowledges that the release and indemnity provisions in paragraph 2 apply to all claims for injury or damage resulting from any cause, including the negligence of any party released herein. Tenant (s) further acknowledge that this agreement shall be binding on all family members, guests, including minors, guardians, heirs and any executor or personal representative or beneficiary. 4. Tenant(s) agrees that this Agreement should be enforced to the full extent permitted by law. If any section or part of this Agreement is held not to be enforceable under the applicable law, the remainder of the Agreement shall be enforced. The release and indemnification provisions of this Agreement do not apply to reckless or intentional acts. Unless such provisions are permitted by the applicable law. 5. This lease shall be governed by and interpreted in accordance with the laws of the State of Hawaii and County of Honolulu. Any action relating to this agreement shall only be instituted and prosecuted in courts in Hawaii. TENANT specifically consents to such jurisdiction and to extraterritorial service of process. Any disputes are subject to be settled by binding arbitration in Honolulu, Hawaii according to the rules of the American Arbitration Association. Should Landlord be required to take any action to enforce or recover under this agreement or should the Tenant initiate any legal proceeding against the Landlord (the Released Party), the tenant shall pay the Landlord's costs of arbitration and litigation including without limitation, reasonable attorney's fees. 6. Tenant (s) state that they are 25 years of age or older and legally competent to sign this Release of Liability and Indemnification Agreement. Tenant (s) understand that these terms are contractual and not a mere recital. Tenant (s) have signed this document of their own free act. 7. Tenant(s) agree to hold owner and agent free and clear of any liability for damage to self or property, resulting from accident, injury or loss of enjoyment resulting from the weather or inoperable appliances or equipment. 8. TENANT(S) HAVE FULLY INFORMED THEMSELVES OF THE CONTENTS OF THIS RELEASE AND INDEMNITY BY READING IT AND ADDRESSING ANY ISSUES PRIOR TO SIGNING SIGNATURES Please sign here that you have read and understand all the above Terms and Conditions, Cancellation Policy, Insurance Policy and Security Deposit information. The foregoing constitutes the entire agreement between the parties and supersedes all other agreements, whether written or oral, express, or limited, and may be modified only if executed in writing by all parties.
